An adviser to the EU's highest court said Tuesday that Gemini may infringe press publishers' rights when it retrieves articles and uses them to construct answers. Advocate General Maciej Szpunar distinguished those outputs from model training, which he said is permitted under the text and data mining exception.

The opinion concerns Hungarian publisher Like Company's lawsuit against Google Ireland over summaries of its articles. Szpunar said copyright protects how news facts are expressed, rather than the facts themselves. Google argues that potentially infringing outputs fall under copyright exceptions. The opinion is nonbinding, and a final ruling is expected in the coming months.
