Federal Trade Commission Chair Andrew Ferguson told the legal news outlet MLex on Friday that American courts should adopt procedural rules that compress antitrust timelines, instead of allowing major cases to stretch out for years while dominant companies continue operating under challenge without consequence. Ferguson said the existing tools are already there. Under the Rules Enabling Act of 1934, courts have the authority to write their own procedural rules, which then take effect unless Congress vetoes them within a set period. He pointed to merger cases, which routinely reach resolution in nine months or less, as a model. The FTC's challenge to the proposed Kroger-Albertsons merger, for example, was an intensely complicated case that moved at speed precisely because judges entered case management orders requiring everyone to move quickly. Ferguson's argument is that monopolization cases, the long conduct suits against single dominant firms, should move at a similar pace, even if that means limiting the number of expert reports or compressing discovery timelines. He acknowledged this would hurt the defense bar. Their ability to prolong these cases is great for lawyers, he said, but added that even defendants would prefer faster resolution. There's no way that Google enjoyed having to pay hundreds of millions of dollars for two giant Section 2 cases that lasted from 2021 to the present. He contrasted that with the DOJ's ad-tech antitrust case against Google, filed in January 2023, which reached a liability verdict and a separate remedies trial in the Eastern District of Virginia in under two years. That pace, Ferguson said, was record-breaking for a case of its kind.
