Microsoft moved for summary judgment on 4 September in New York litigation over training AI models on books, the report says.

Its memorandum cited an expert analysis that found 24 matching Copilot responses in 8.2 million conversations and no matches for 202 of the 212 books at issue. The litigation combines claims from authors, publishers and 400 local newspapers before Judge Sidney Stein. Microsoft is asking the court to decide whether the training use is fair use as a matter of law.
