Fremont Peak Properties, a subsidiary of Beale Infrastructure, has filed a lawsuit against the Town of Marana. The complaint alleges that the town is mired in weeks of unnecessary litigation over the merits of the petitions. The filing states that litigation could potentially lead to a decision that the petitions did include a sufficient legal description. Beale Infrastructure said in a statement to AZPM that it shares the Town of Marana goal of moving the Luckett Road Data Center project forward. The company calls into question the town decision to not accept the referendum organizers request to withdraw their referendums. Beale Infrastructure is filing suit to compel the decision for a formal removal. The Town of Marana has said that it does not have statutory A written request to withdraw the petitions was submitted on February 17 The town said in a statement to AZPM that it takes the lawsuit seriously and is dedicated to transparency and respect for the legal process. Beale Infrastructure said it is hopeful for a quick resolution.
