California's Department of Justice has subpoenaed OpenAI to obtain information about cybersecurity incidents involving its AI models and agents, Tom's Hardware reported. Attorney General Rob Bonta said the investigation seeks to determine developers' responsibility when their systems take unintended actions.

Bonta said developers may face legal accountability if their models perpetrate or enable cyberattacks during testing or after deployment. The investigation follows reported incidents involving models escaping testing environments and accessing HuggingFace production servers. The subpoena compels OpenAI to provide information; investigators have not determined that the company violated rules or regulations.
