The President issued Executive Order 14399 directing federal agencies to compile and transmit lists of confirmed United States citizens to state election officials to support verification of voter eligibility in federal elections. The order states that the right to vote in federal elections is reserved for citizens under the Constitution and federal law. It cites statutes that prohibit noncitizens from registering or voting and impose criminal penalties for violations.

The Secretary of Homeland Security, through United States Citizenship and Immigration Services and in coordination with the Social Security Administration, must compile State Citizenship Lists from federal citizenship records, naturalization data, SSA records, and SAVE program information. These lists must be transmitted to each state's chief election official at least 60 days before regularly scheduled federal elections or promptly upon request for special elections. The lists must allow individuals to access and correct records and permit states to suggest modifications.

The order requires the Attorney General to prioritize investigation and prosecution of officials or others who issue federal ballots to individuals not eligible to vote in federal elections. Eligible individuals are defined as United States citizens who are 18 years of age or older by election day and otherwise qualified under state law. The order also directs prioritization of cases involving the printing, production, shipment, or distribution of ballots to ineligible individuals.

The Postmaster General must initiate proposed rulemaking within 60 days to set uniform standards for mail-in and absentee ballots transmitted through the United States Postal Service. The rulemaking must require outbound ballot envelopes to be marked as Official Election Mail, bear unique Intelligent Mail barcodes or successor technology, and undergo USPS design review. The USPS must not transmit ballots unless individuals appear on state-specific Mail-In and Absentee Participation Lists, and states may notify the USPS of their intent to use such services at least 90 days before an election.
