3 (Reuters) - Broadcom on Monday lost its bid to suspend a European Union antitrust request for U.S. legal documents protected by U.S. legal professional privilege in a case related to VMware, which it acquired in 2023, after an EU court sided with regulators, Reuters reported via SRN News.

The U.S. chipmaker in May asked the Luxembourg-based General Court for an interim measure against the European Commission after a demand to present documents produced outside the EU. Broadcom argued the request conflicted with U.S. attorney-client privilege. In the EU, that status covers communications with external lawyers but not in-house counsel.

The General Court rejected Broadcom's arguments. The judge said it is for the Commission to decide whether particular information is necessary to uncover competition-rule infringements, and that letting the investigated firm decide relevance would undermine the Commission's powers, Reuters reported.
