FTC orders nine companies to disclose personalized pricing and pay practices

The Federal Trade Commission ordered nine companies to provide information on how they use personal data to set consumer prices and worker compensation. The recipients are Delta, United, JetBlue, Lyft, Uber, DoorDash, Instacart, Target and Walmart. Issued under Section 6(b) of the FTC Act, the orders seek the inputs, tools and procedures used to adjust prices and pay, including whether personal data or loyalty participation affects individual offers. Companies have 45 days after receiving the orders to respond; the FTC can seek federal court enforcement if they fail to comply. The commission approved the orders 2-0. Section 6(b) permits studies without a specific law enforcement purpose.
